Welcome to China-Gel Shop! China-Gel Shop is operated by China-Gel LLC. The terms "we", "us" and "our" refer to China-Gel LLC. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). China-Gel Shop is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these "Terms of Service"), describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other non-waivable statutory rights.
1. Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
Some areas of the Services, such as our professional section, are available only to customers we have approved. We may grant, limit or remove access to these areas at our discretion.
2. Our Products
We have made every effort to accurately represent our products in our online store. However, colors or product appearance may differ from how they appear on your screen, depending on your device and its settings. We do not warrant that the appearance or quality of any product purchased by you will meet your expectations or be the same as depicted in our online store. All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

Information on or through the Services, including product descriptions, articles, blog posts, reviews and testimonials, is provided for general information only and is not medical advice. It is not intended to diagnose, treat, cure or prevent any disease. Always read and follow the product label and directions. 4. Orders
When you place an order, you are making an offer to purchase and you authorize us and our payment processors to charge your selected payment method for the total amount of your order. We reserve the right to accept or decline your order for any reason at our discretion, subject to applicable law. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after an order is accepted. We may limit or cancel quantities purchased per person, per household or per order, including orders placed by or under the same customer account, payment method, or billing or shipping address. If we do not accept, change or cancel an order, we may attempt to notify you using the email address, billing address and/or phone number provided with the order.
Your purchases are subject to return or exchange solely in accordance with our Return & Exchange Policy. This does not limit any rights you may have under applicable law. Unless you have an approved professional account or we have agreed otherwise in writing, you represent that your purchases are for your own personal or household use and not for resale.
5. Subscriptions
Some products may be offered as a Subscribe & Save subscription. If you purchase a subscription, you authorize us and our payment processors to charge your payment method for each renewal order, at the price and frequency shown at checkout, until you cancel. 6. Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes or shipping and handling charges. Prices in our online store may differ from prices offered by retailers or in stores operated by third parties. We may offer promotions from time to time that are governed by separate terms and conditions; if those terms conflict with these Terms of Service, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store, and to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed. You represent and warrant that (1) you are authorized to use the payment method you provide, (2) the information you provide for that payment method is true, correct and complete, (3) charges incurred by you will be honored by the provider of your payment method, and (4) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes.
7. Shipping and Delivery
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, supply shortages, utility or telecommunications outages, cyber incidents or governmental actions. To the fullest extent permitted by applicable law, title and risk of loss pass to you when we transfer products to the carrier. See our Shipping Policy for more details.
8. Intellectual Property
Our Services, including all trademarks, brands, text, images, graphics, product reviews, video and audio, are owned by China-Gel LLC, its affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. These Terms of Service permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent. Our names, logos, product names, designs and slogans, including aulief and Nature's Lief, are trademarks of China-Gel LLC or its licensors, and you must not use them without our prior written permission. All other names, logos and trademarks on the Services belong to their respective owners.
9. Optional Tools
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We have no liability arising from or relating to your use of optional third-party tools. Any use of these tools is entirely at your own risk and discretion, and you should make sure you are familiar with and approve of the terms on which the relevant third-party provider offers them. Any new features or tools we offer through the Services in the future are also subject to these Terms of Service.
10. Third-Party Links
The Services may contain materials from, and links to websites provided or operated by, third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to access these materials or websites, you do so at your own risk. We are not liable for any harm or damages related to your access to any third-party website, or your purchase or use of any products, services, resources or content on any third-party website. Please review the third party's policies and practices carefully before you engage in any transaction. 11. Relationship with Shopify
China-Gel Shop is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with China-Gel LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and China-Gel LLC, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with China-Gel LLC.
12. Privacy Policy

13. Reviews, Comments and Feedback

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if information is inaccurate, including after an order is submitted. If we cancel an order after payment has been collected, we will refund the amount charged.

We may terminate this agreement or your access to the Services (or any part of them) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections 8 and 13 through 26, and any other provisions that by their nature should survive termination, will continue to apply after termination.

19. Limitation of Liability
To the fullest extent permitted by law, in no case shall China-Gel LLC, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any products procured using the Services, or for any other claim related in any way to your use of the Services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Services or any content (or product) posted, transmitted or otherwise made available via the Services, even if advised of their possibility. Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law.
20. Indemnification
You agree to indemnify, defend and hold harmless China-Gel LLC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, or (2) your violation of any law or the rights of a third party.
21. Severability
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service without affecting the validity and enforceability of the remaining provisions. Nothing in these Terms of Service limits any rights you may have under applicable consumer protection laws or other laws that cannot be waived by contract. 22. Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms of Service does not waive that right or provision. These Terms of Service are governed by the laws of the State of Illinois and applicable federal law of the United States, without regard to conflict-of-law principles. You and China-Gel LLC consent to the jurisdiction and venue of the state and federal courts located in the State of Illinois, except where prohibited by applicable law. Nothing in this section limits any rights you may have to bring claims in your local courts or to rely on mandatory laws that apply in your place of residence.

By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, in-account notice or posting on the Services. These communications may relate to your orders, account, subscriptions, purchases, returns, these Terms of Service or other Services-related matters.
